The petitioner is in custody since 18.12.2013 in connection with Birpur P.S. Case No.123 of 2013 registered for the offences under Section 420 and other sections of the Indian Penal Code.
It is submitted on behalf of the petitioner that four cases of similar nature were registered; one after another in order to wreck vengeance. The petitioner had taken the generator on rent while he was posted as Police Inspector in Birpur Police Station, but did not return the same to the informant. It is further submitted on behalf of the petitioner that in connection with three other cases, the petitioner has already been extended the privilege of bail
Patna High Court Cr.Misc. No.46517 of 2014 (3) dt.16-02-2015 2/2 by the court below in Birpur P.S. Case No.122 of 2013 and Birpur P.S. Case No.124 of 2013 whereas in Birpur P.S. Case No.125 of 2013, the petitioner has been extended the privilege of bail by this Hon'ble Court in Cr.Misc. No.33791 of 2014, vide order dated 23.9.2014.
Considering the aforementioned submissions and also the fact that the petitioner has been in custody since 18.12.2013, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Shri Deo Priya Kumar, learned Judicial Magistrate, 1st Class, Begusarai, in connection with Birpur P.S.
