JUSTICE SANJAY PRIYA ORAL JUDGMENT Date : 13-05-2019 This writ application has been filed for issuance of appropriate writ or direction commanding the RespondentDistrict Authority to protect the life and property of the petitioner's society, who has been targetted by the person of vested interest to force him out from the business of sand. Heard Mr. Dhananjay Kumar learned counsel for the petitioner and Smt. Nivedita Nirvikar, GA-7 counsel appearing on behalf of the State.

Counter affidavit has been filed on behalf of the State. It is mentioned in paragraph-17 of the counter affidavit that whenever the petitioner has made his complaint before the concerned Police Station, case has been registered against the

Patna High Court CWJC No.15843 of 2016 dt.13-05-2019 2/2 accused persons and after investigation and supervision of the case, charge-sheet has been filed. The concerned Police Station has been directed to keep vigil eye on the situation and take action accordingly.

In such circumstances, from aforesaid statement of the State, this Court finds that the State has taken appropriate action on the complaint made by the petitioner. The Respondent-District Authority is directed to take appropriate action in accordance with law in the event the complaint is made by the petitioner before the concerned authority/Police Station during pendency of the lease period with regard to protection of life and property of the petitioner's society.
