The petitioner is apprehending his arrest in a case registered under Sections 30A, 30B of the Bihar Prohibition and Excise Act, 2016 and 467, 468, 471 and 414 of the Indian Penal Code.

The prosecution case, in short, is that in a search carried out by the police, 6 liters liquor and stolen vehicles were recovered.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. As per the prosecution case, the police has made a

No liquor is said to have been recovered from the house of the petitioner. The two motorcycles which is said to have been recovered belong to the family of the petitioner. The motorcycle in questions are not stolen property.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, West Champaran, Bettiah in connection with Chanpatia Sirisiya O.P. P.S. Case No. 339/18, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
