The petitioner has prayed for regular bail in a case instituted for the offence under Sections 341, 323, 337, 307, 504, 506/34 of the Indian Penal Code read with Section 27 of the Arms Act.
The allegation against the petitioner along with others is of abusing and assaulting the informant. It is further alleged that the petitioner shot fired upon the son of the informant namely Prashant Kumar, due to which he sustained injury. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to garbage dispute. He has committed no offence. There is a case and counter case between the parties. Members of both parties
Patna High Court CR. MISC. No.8452 of 2023(4) dt.20-06-2023 2/2 have sustained injuries. From the perusal of the Supplementary report of the injured person, the doctor opined that the injury caused by fire arms is simple in nature, which is annexed with the case diary. He is languishing in judicial custody since 21.10.2022.
The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 494 of 2018.
