The petitioner is in custody since 5.6.2014 in connection with Dhamdaha P.S. Case No.125 of 2014 registered for the offences under Section 47A of the Excise Act. It is submitted on behalf of the petitioner that illicit liquor is said to have been recovered from auto-rickshaw, bearing Registration No.BR-11-M-3686. It is submitted that the petitioner has no criminal antecedents and it is a case of first offender under Section 47A of the Excise Act.

Considering the aforementioned submissions and also the period of custody, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the
