The petitioner is in custody in a case registered under Sections 25(1-b)a and 26(ii) of Arms Act.

It is alleged by the informant that from the possession of the petitioner one loaded country made pistol, two live cartridges, three mobiles, ten sims and one motorcycle without any paper were recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.3.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. As per prosecution case, one loaded country made pistol along with two live cartridges are said

Patna High Court Cr.Misc. No.38556 of 2015 (3) dt.08-10-2015 2/2 to have been recovered from the possession of the petitioner. It is further submitted that no compliance of Section 100 Cr.P.C. has been followed.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Muzaffarpur in Kazimohammadpur P.S.Case No.122/2015.
