The petitioner is in custody in Daraunda (M.H. Nagar ) P.S.Case no.

of registered under Sections 302/307/447/34 of the Indian Penal Code and 27 of Arms Act, pending in the Court of learned C.J.M., Siwan. The prosecution case in, brief, is that It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.1.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. There is allegation of indiscriminate firing by the accused persons and the deceased is said to have sustained two fire arm injuries.

Patna High Court Cr.Misc. No.38582 of 2015 (3) dt.08-10-2015 2/2 On behalf of the State, it has been submitted that the petitioner is named in the FIR. There is specific allegation against the petitioner and co-accused Amarjit of firing upon the deceased. It is further submitted on behalf of the State that the petitioner has got criminal antecedent.

Considering the facts aforesaid, I am not inclined to grant bail to the petitioner and same is rejected. Any how, the trial court is directed to take all necessary steps to expedite the trial and conclude the same within a period of one year from the date of receipt/production of a copy of this order.
