Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 Petitioner seeks bail in connection with Katra P.S. Case No. 78 of 2019, registered for the offences punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act. Allegation is of recovery of one Magazine and five cartridges from a bag and names of petitioner and other accused persons disclosed by the villagers, who succeeded in fleeing away and it appears that petitioner is accused in five other cases of serious nature.

Submission of learned counsel for the petitioner is that though it is alleged that villagers have disclosed his name but no statement of villagers has been recorded during investigation and he is in custody since 30.11.2019. Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.6934 of 2020(3) dt.27-02-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIV-cum-Sub Judge, Muzaffarpur, in connection with Katra P.S. Case No. 78 of 2019 on the condition that he has to appear before police station of his local area in second week of every month for a period of six months, so that police may watch his activities and if any active involvement of the petitioner is found in such type of cases, prosecution is at liberty to move for cancellation of his bail bonds. Let a copy of this order be communicated to the Sr. Superintendent of Police, Muzaffarpur for needful. (Vinod Kumar Sinha, J) spal/- U T
