JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case under sections 406, 420 and 120(B) of the Indian Penal Code.

It is alleged that the petitioner used to cheat persons through Mobile phone on the pretext that they have got a lucky draw of Rs.50 lacs and they should deposit some money towards tax and other formalities in order to avail the award money. The petitioner submits that he has very meager amount in his Bank Account and has no criminal antecedent. He is in custody since more than six months.

Considering the facts and circumstances of the case, the petitioner Manish Kumar is directed to be released on bail in connection with Shashtri Nagar P.S. Case No.300 of 2014 on furnishing bail bond of Rs.5,000/- with two sureties of the like

Patna High Court Cr.Misc. No.47386 of 2014 (2) dt.03-03-2015 amount each to the satisfaction of the Chief Judicial Magistrate, Patna subject to the conditions that he would report to the police station concerned once in every two months.
