JUSTICE MUNGESHWAR SAHOO ORAL ORDER 30-01-2016 Heard the learned counsel for the petitioner and the learned counsel for the State.
The petitioner is in custody since 09.08.2015 in Karpi P.S. Case No.109 of 2015 under Section 341, 323, 307, 504/ 34 IPC. According to the prosecution case, this petitioner along with other surrounded the informant's son and this petitioner and Lal Kanhaia Ram gave chura blow at the neck of the informant's son who felled down and thereafter, they went away thinking that he has died. The son of the informant was taken to hospital. The case diary was called for. From perusal of the case diary, it appears that the informant's son was admitted in PMCH on 18.06.2015. Operation was held on the same day on the cut throat of the son of the informant. The son of the informant was discharged on 7.9.2015, i.e., after more than 2 1⁄2 months.
