JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-01-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as learned APP for the State through video conferencing. The petitioners apprehend their arrest in connection with Daudnagar P.S. Case No. 197 of 2020, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 337, 338, 153, 353, 332, 283, 269, 270, 188, 504 of the Indian Penal Code and Section 3 of the Epidemic Act.
The SHO is the informant of this case. On 13.07.2020 the informant got information that NH-139 near village-Tarari was blocked by the villagers having kept two dead bodies on the road as both the persons died in a road accident. The mob was demanding
Patna High Court CR. MISC. No.21176 of 2021(2) dt.24-01-2022 2/2 compensation. The informant along with police force reached the place of occurrence and found that about 100-125 persons including the petitioners have blocked the road, they also threw the brickbats and caused injuries to some police personnel. On similar footing co-accused persons have been granted anticipatory bail vide Cr. Misc. No. 14113 of 2021 vide order dated 11.01.2022.
Considering the above-mentioned facts and circumstances, let the petitioners be released on anticipatory bail in the event of their arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 197 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
