2. The petitioners seek bail in connection with Dandari P.S. Case No. 109 of 2025 registered for the offence under Sections 103(1), 3(5) of the BNS.

3. As per the prosecution case, the petitioners are accused of killing the deceased.

4. The petitioner no. 01 is in custody since 27.08.2025 and the petitioner no. 02 is in custody since 18.08.2025.

5. Learned counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in this case. He further submits that one co-accused namely Vishal Kumar has said that he has called the deceased saying that the petitioners were calling him and thereafter on the next day, the dead body of the deceased was found and only

Patna High Court CR. MISC. No.7895 of 2026(3) dt.26-03-2026 2/2 because of this the name of the petitioners has transpired in this case. He further submits that no material has come in the case diary against the petitioners.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Dandari P.S. Case No. 109 of 2025.

8. As a condition of this order, the petitioners, after being released on bail, are directed to co-operate in the trial either by appearing personally or through their lawyer in the trial Court on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioners.
