JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is named in the FIR but only suspicion has been raised against him on the ground that on the date of occurrence he took the deceased with him. Learned Sessions Judge has referred para-58 of the case diary to show that a wrist watch of the deceased was recovered from the possession of the petitioner but para-56 of the case diary reveals that the petitioner was not caught by the police rather the villagers caught the petitioner and produced him before the police along with the wrist watch.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named

Patna High Court Cr.Misc. No.20485 of 2015 (4) dt.08-10-2015 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barachatty P.S. Case No. 05/2014 to the satisfaction of the Sub-Divisional Judicial Magistrate, Sherghaty, Gaya.
