Petitioner is very much named in the first information report and according to the prosecution case he participated in the alleged occurrence in which several persons were killed by the culprits. No doubt one co-accused Birbal Murmu @ Birbal Murmu @ Panchu Murmu has been granted bail by a bench of this court vide order passed in Cri. Misc. No. 21693 of 2015, but I am not inclined to release the petitioner on bail and hence taking note of the aforesaid fact as well as criminal antecedent of the petitioner, the prayer for bail of the petitioner in connection with Dharhara P.S. Case no. 74 of 2011, corresponding to S.Tr. No. 5 of 2015 pending in the court of Additional Sessions Judge-III, Munger, stands rejected.
