The petitioner has preferred this application for grant of regular bail in connection with a case registered under sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, the petitioner and one another accused who are both the brothers of the son-in-law of the informant are stated to have beaten up and thereafter burnt the informant's daughter by pouring kerosene oil on her. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The informant is admittedly not an eye-witness to the occurrence. The informant has not made the son-in-law as an accused but has implicated the petitioner for oblique reasons. The petitioner is in custody

Patna High Court CR. MISC. No.19052 of 2021(3) dt.21-10-2021 2/2 since 14.6.2020.

The application for bail is opposed by learned APP for the State who submits that there is direct allegation against the petitioner which is substantiated from the postmortem report.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the direct allegation against the petitioner as also one Raju Kumar of having burnt the daughter of the informant by pouring kerosene oil, the fact which has been substantiated from the contents of the postmortem report, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
