2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 325, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, informant, namely Shyam Sundari Devi, alleged that on 06.05.2024 at about 11 AM, while her son, namely Ram Krishna Singh, was cultivating his land in the meantime, all the accused persons named in the F.I.R., including this petitioner, armed with rods, came there and abused and assaulted son of informant causing fracture injury in his right hand.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Allegation of assault is vague and omnibus and there is no specific accusation of assault against this petitioner. As a matter of fact, due to land dispute between the parties, simple maar-peet took place in which both sides sustained injuries. There is case and counter-case between the parties and the present case is counter-blast of Pipariya P.S. Case No. 41 of 2024 which was lodged earlier in point of time. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the aforesaid facts and circumstances, general and omnibus nature of accusation, case and counter-case between the parties and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class,
