The petitioner seeks bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution case, in short, is that five litres mixed Rava and Mahua as well as ten kg Gur is recovered. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 08-11-2019. It is alleged that five litres mixed Rava and Mahua as well as ten kg Gur is recovered. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner had no knowledge regarding the alleged incident. There is no compliance of Section 100 Cr.P.C.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Nawada in connection with Nawada Town P.S.
