According to the prosecution case the petitioner was working with the informant and informant handed over to him two lakh Nepali Currency to convert the aforesaid currency into Indian Currency but the petitioner did not return the aforesaid amount to the informant. It would appear from the perusal of the case diary that except oral statement of witnesses there is nothing in the entire case diary to prove the aforesaid accusation. Moreover, the submission on behalf of the petitioner is that petitioner has been implicated in this false case by the informant on account of dispute of wages.
Considering the aforesaid facts and
Patna High Court Cr.Misc. No.20760 of 2015 (3) dt.08-10-2015 2/2 circumstances as well as submissions of the parties , let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in Jaynagar P.S. Case no. 36 of 2010.
