In the background of prevailing animosity amongst the parties, it has been alleged by the informant, Bindeshwar Sahani that while he along with his cousin brother, Laldeo Sahani and co-villager, Ramhit Sahani were at the pond situated at Lilwa Chaur to guard, Ram Lalit Sahni, Raju Sahni, Ramadhar Sahni, Dhaneshwar Sahni, Binod Sahni, Pali Sahni (petitioner), wife of Ram Lalit Sahni and wife of Ramadhar Sahni raided his house, took away Ram Shreshth Sahni, brutally assaulted and threw him in Chaur. Then thereafter, all of them also pounced upon them and during course thereof, Ram Lalit Sahni gave butt blow over his head.
From the order impugned, it is evident that Ram
Patna High Court Cr.Misc. No.47564 of 2014 (2) dt.03-03-2015 Shreshth Sahni, subsequently, died in a way to Hajipur for better treatment and on account thereof, there happens to be addition of Section 302 IPC. Furthermore, it is apparent therefrom that no specific allegation has been attributed to the petitioner. Moreover, co-accused, Malti Devi vide Cr.Misc.No.25256/2013, Dhaneshwar Sahni vide Cr.Misc. No. 27815/2013 and Raju Sahni vide Cr.Misc.No. 4074/2014 have already been granted bail. Accordingly, petitioner, Pali Sahni is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Rajiv Ranjan Singh, Judicial Magistrate, 1st Class, Vaishali in Tisiauta P.S. Case No.12/13.
