JUSTICE SANJAY PRIYA ORAL JUDGMENT Date : 27-05-2019 This writ petition has been filed by the petitioner for issuance of writ of mandamus directing the authorities concerned for mutation of ancestral land belonging to his mother's father whose name was mentioned in the survey being the only daughter validly entitled under the law.

Heard Mr. Sanjeev Kumar, learned counsel for the petitioner and Mr. Rishi Raj Sinha, SC-19, appearing on behalf of the State.

Patna High Court CWJC No.19271 of 2016 dt.27-05-2019 2/2 This Court finds that no proper application for mutation of land has been filed by the petitioner before the competent authority. Therefore, writ of mandamus can not be issued by this Court at this stage to the authority concerned as prayed for by the petitioner in the writ application.

This writ application is accordingly dismissed. Petitioner is at liberty to file appropriate application before the competent authority for mutation of his name with regard to land in question along with relevant documents, which shall be disposed off by the authority concerned in accordance with law within a period of three months from the date of filing of such petition by petitioner.
