The victim and petitioner themselves appeared before the police which is evident from perusal of paragraph 29 of the case diary and thereafter the statement of the victim was recorded under section 164 Cr.P.C. in which she stated that she solemnized her marriage with the petitioner out of her own sweet will . The victim was medically examined and she was found 15 to 16 years.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.20785 of 2015 (3) dt.08-10-2015 2/2 Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in Muzaffarpur Town P.S. Case No. 40 of 2015.
