This application for grant of regular bail arises out of Tandwa P.S. Case No. 23 of 2015, disclosing offences under Section 395 of the Indian Penal Code.

In Criminal Miscellaneous No. 42668 of 2015, the petitioner was not named in the First Information Report. The offence relates to commission of dacoity in Punjab National Bank, Tandwa.

It appears that the petitioner and one Danvir Singh were arrested, having been found in possession of pistol and live cartridges leading to institution of Tandwa P.S. Case No. 27 of 2015. It is alleged that this petitioner and said Danbir Singh confessed their involvement in the present case, before the Police, when they were in custody in connection with Tandwa P.S. Case No. 27 of 2015.

Patna High Court Cr.Misc. No.50925 of 2015 (2) dt.24-11-2015 2/2 Learned senior counsel appearing for the petitioner has submitted that no material has been recovered from the petitioner's possession nor there is any incriminating material available against the petitioner to the extent it relates to his involvement in the present Tandwa P.S. Case No. 23 of 2015 over and above the so called confessional statement said to have been made before the police. He has submitted that similarly circumstanced co-accused Danvir Singh has been granted bail by this Court vide order dated 17.09.2015 passed in Criminal Miscellaneous No.42668 of 2015.

In view of the submission as above, this application is allowed.

Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Tandwa P.S. Case No. 23 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
