ANJANA MISHRA ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner, learned counsel for the informant and the learned counsel for the State. The petitioner is in custody since 17.08.2014 in connection with Yadopur P.S. Case No. 62 of 2014 registered for the offences punishable under Sections 147, 148, 149, 302, 307, 323, 341, 504 and 506 of the Indian Penal Code. The allegation against the petitioner is that he being solely instrumental, participated in an occurrence of marpit and instigated others to attack the deceased Raja Yadav and the informant. After treatment, the said Raja Yadav succumbed to the injuries inflicted the present petitioner.
However, considering the nature of the case and the fact that the petitioner actively participated in the occurrence
Patna High Court Cr.Misc. No.47250 of 2014 (2) dt.04-02-2015 leading to the death of Raja Yadav, I am not inclined to grant the privilege of bail to the petitioner, accordingly, this bail application is rejected.
