This is the second attempt on behalf of the petitioner for grant of regular bail in connection with Sursand P.S. Case No.633 of 2022 registered for the offence under Sections 406, 420 and 379 of the Indian Penal Code. 3.

Earlier, the bail application of the petitioner has been rejected vide order dated 13.12.2023 passed in Criminal Miscellaneous No.67443 of 2023 with an observation that the petitioner may renew his prayer for bail after recovery of the truck in question.

Learned counsel for the petitioner, relying on Annexure-3 to this bail application, has submitted that the truck in question has been recovered.

Considering the fact that the truck in question has been recovered, this application is allowed. 6.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Sursand P.S. Case No.633 of 2022.
