====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 08-10-2015 In the light of my order dated 07.10.2015 Member Secretary, Bihar State Legal Services Authority has appeared and states that daughter of the victim of Bhabua P.S. Case No. 259 of 2014 has not only appeared before him but also informed the Authority that trial is not making any progress, there is likelihood of the accused persons being granted bail and thereafter tamper with the evidence.

In view of the apprehension expressed by the daughter of the victim of the present case it is directed that if the case has been committed to the Court of Sessions and charges framed, trial should not only be expedited but concluded within

Patna High Court Cr.Misc. No.46335 of 2015 (3) dt.08-10-2015 four months from the date of receipt/production of a copy of this order in the court below. In the event case has not been committed to the Court of Sessions as yet, same be committed forthwith after serving police papers to the three accused persons, thereafter charges framed within one week of the commitment, trial concluded within four months from the date of commitment.

With the aforesaid observation, the petition is disposed of.

Let this order be communicated through fax by the office of the High Court not only to the District Judge, Chief Judicial Magistrate, Kaimur at Bhabua but also to the court concerned if the same has been transferred to any other court.
