1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Kopa P.S. Case No. 168 of 2023 dated 08.08.2023 registered under Sections 147, 149, 341, 323, 324, 379, 307 and 504 of the I.P.C.

3. As per the First Information Report the informant went to the matrimonial home of his daughter on her call on 06.02.2023 in the evening where all the accused persons including the petitioner abused the informant. The petitioner assaulted the informant by means of daab on his head due to which he sustained head injury.

4. Learned counsel for the petitioner submits that informant is the father- in- law of the petitioner. There is matrimonial discord between the petitioner and his wife. The petitioner has

Patna High Court CR. MISC. No.12196 of 2024(2) dt.12-03-2024 2/2 also lodged an F.I.R. bearing Kopa P.S. Case No. 167 of 2023 against his wife and her family members. The side of the petitioner have also sustained injuries. The injury caused to the informant is simple in nature as would be evident from the impugned order itself.

Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are closely related, there is case and counter case between them and injury caused to the informant is simple in nature, as such, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Saran at Chapra in connection with Kopa P.S. Case No. 168 of 2023 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
