The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 353 and 504/34 of the IPC.

The prosecution case, as per the written report of A.S.I., Vinay Kumar Pandey, dated 30.10.2018, submitted to the Station House Officer, Rajepur Police Station, is to the effect that on the same day, at about 5.30 P.M., while the informant was on patrolling duty, he received an information from the Chaukidar that the petitioner is creating nuisance at Bala Kothi market, whereupon the informant along with other police personnel, reached on the spot and apprehended the petitioner,

Patna High Court Cr.Misc. No.8669 of 2019(2) dt.14-02-2019 2/2 but he was being released by 6-7 co-accused persons. Considering the nature of accusation, this Court does not think that the present anticipatory bail application of the petitioner is maintainable.

However, keeping in view the nature of accusation and statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, it is a case for consideration of regular by the learned Court below if the petitioner surrenders within a period of six weeks, in connection with Rajepur P.S. Case No. 181 of 2018, pending in the Court of learned Chief Judicial Magistrate, East Champaran, Motihari. Accordingly, the present application is disposed of. (Dinesh Kumar Singh, J) Amrendra/- U T
