JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 04-05-2018 The vehicle of the petitioner has been seized in connection with Bikram P.S. Case No. 374/2017 for offences under Sections 279, 337 and 338 of the Indian Penal Code. The argument of the petitioner is that vehicle is lying under the open sky since its seizure and is likely to loose its real worthiness over the period of time.

The petitioner is said to have made application under Section 457 of the Cr.P.C. before the learned Additional Chief Judicial Magistrate IV, Danapur praying for the release of the vehicle bearing Registration No. UP70CT9383 but the said application is not being disposed of because the report, called for from the office of the District Transport Officer vide order dated

Patna High Court Cr. WJC No.1199 of 2018 (2) dt.04-05-2018 2/2 12.02.2018, has not been made available to the learned Additional Chief Judicial Magistrate IV, Danapur.

Learned counsel for the State is present.

In the given circumstances, the learned Additional Chief Judicial Magistrate IV, Danapur is directed to consider the application for release of the vehicle of the petitioner and dispose of the same within a period of one month from today after giving one last opportunity to the Transport Officer to submit his report. The application shall not be kept pending only for the reason that the report is not being sent by the concerned office. The application is, hence, disposed of.
