JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Petitioner was apprehended red-handed and from his possession cash appertaining to Rs.40,000/- as well as voter identity card of informant Punam Devi was recovered. It has been submitted on behalf of petitioner that he happens to be under custody since 29.01.2014, has no criminal antecedent. Furthermore, it has been submitted that from the written report itself, it is evident that he happens to be handicapped. Furthermore, petitioner has sufficiently been punished inconsonance with the nature of allegation. On the other hand, learned Additional Public Prosecutor opposed the prayer.

Absence of criminal antecedent coupled with period

Patna High Court Cr.Misc. No.47568 of 2014 (02) dt.03-03-2015 of detention is found for the present to release the petitioner on bail and accordingly, petitioner Ravindra Thakur is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkaulia P. S. Case no.70 of 2014.
