The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420 & 409 of the Indian Penal Code.
The case of prosecution, in brief, is that the Block Development Officer, Surajpura, vide latter dt. 7.11.2020, had made a complaint that the petitioner who is ward member of Gram Panchayat Shiobahar of ward no. 5 along with other coaccused persons, illegally withdrawn a sum of Rs. 22,70,000/- meant for the Nal Jal Yojna to be carried out in the Gram Panchayat, however, the work was not completed resulting in the accused persons having defalcated the said money. Learned counsel for the petitioner submits that the

The petitioner completely denies his participation and no way connected with the alleged offence in any manner and he has falsely been made accused in this case due to save the skin of Munna Singh and Ajay Singh who were contractor of the scheme of Nal Jal Yojana of said Gram Panchayat and the petitioner has also lodged a complaint case no. 168 of 2022 against them. It is further submitted that co-accused namely, Krishna Kumar who is Ward Secretary of the said Gram Panchayat has already been granted bail by a co-ordinate Bench of this Court vide order 17.1.2023 passed in Cr. Misc. No. 61689 of 2022, hence, the case of this petitioner stands on better footing. Moreover, the petitioner has got no criminal antecedent and languishing in judicial custody since 25.4.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Suryapura P.S. Case No. 13 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand)
