The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery of an auto rickshaw is against unknown.

Submission is that nothing incriminating was recovered from the possession of the petitioner nor the petitioner was ever put on Test Identification Parade during investigation of the case, which is now complete. The petitioner has been implicated in this case only on suspicion based on criminal antecedent. Thereafter, confessional statement of the petitioner has been recorded by the police.

No.7866 of 2019(4) dt.24-04-2019 2/2 Considering the fact that there is no substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sitamarhi P.S. Case No.133 of 2018, with condition that petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
