The petitioners in Cr. Misc. No. 49370/2014 and Cr. Misc. No. 47635/2014, namely, Basu Sahani and Chandra Mohan Mahto, seek their bail in a case under Sections 395 of the Indian Penal Code.
These are cases of highway robbery of loaded trucks.
Patna High Court Cr.Misc. No.49370 of 2014 (4) dt.04-08-2015 2/2 The petitioners are not named in the F.I.R. and nothing has been recovered from the possession of the petitioners. Name of the petitioners figured in the case in the confessional statement of coaccused. The petitioners were not put on T.I.P. Similarly situated co-accused Krit Mahto, Sachet Yadav, Arjun Sahani and Hira Lal Sahani have already been enlarged on bail.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sadar at Motihari in Kotwa P.S. Case No. 65 of 2014. (Prabhat Kumar Jha, J) Dilip/- U T
