JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 17-05-2017 The petitioner has filed the contempt petition for willful disobedience of order dated 25.7.2016, passed in C.W.J.C.No. 6493 of 2016.

Petitioner is owner of a rice mill and was entrusted paddy for its milling for the session 2013-14 and 2014-15. He submitted that he had given entire proportionate quantity of the CMR (rice) to the Bihar State Food and Civil Supplies Corporation Ltd. and submitted bill amount of Rs.12,95,000.62 against the milling, transportation and handling and other charges which was still not paid to him. It was the case of the

Patna High Court MJC No.3747 of 2016 (4) dt.17-05-2017 2/2 petitioner that the authorities should either adjust his bill against the outstanding, and pay him the rest amount, so that he could repay the loan amount taken for procurement of paddy. The petitioner in this respect had also filed representation before the District Manager, Bihar State Food Corporation, Purnea. The writ petition was disposed of with a direction to the respondents to dispose of the representation of the petitioner (annexure-2). The petitioner submits that in fact his case has not been considered as opposite parties have not addressed his grievances.

The contempt petition is disposed of with observation that the petitioner should again file his representation before the opposite parties, who will consider all aspects of the matter and pass appropriate order within two months thereafter. This court has not expressed its opinion on the merits of the case. The contempt petition is thus disposed of.
