Petitioner seeks bail in a case registered for the offences punishable under Sections 328, 302, 120B/34 of the Indian Penal Code.

One Pappu Singh died in jail. Suspicion is that his murder was committed by administering poison. Suspicion is against jail authority. During investigation name of the petitioner surfaced as he was also a prisoner along with deceased in the same ward. However, there is no direct evidence that the petitioner was seen administering poison to the victim. Petitioner is in custody since 15.12.2018.

Learned counsel for the informant opposed the prayer for bail especially on the ground of long list of criminal

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bettiah Town Police Station Case No. 313 of 2012, with the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/Banti U T
