While police had gone into investigations of Sarai P.S. Case No.112 of 2014 found appearance of petitioner along with Sanjay suspicious one who were chased, apprehended and searched, during course of which from the possession of petitioner countrymade loaded pistol was recovered while from possession of Sanjay, cartridge has been recovered. Petitioner happens to be under custody since 10-07-2014. Accordingly, petitioner Munna Baitha is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Sri A. Alam, Judicial Magistrate, 1st Class, Vaishali at Hajipur / successor in office in connection with Sarai P.S. Case No.113 of 2014. However, taking into account the criminal antecedent of the petitioner it
Patna High Court Cr.Misc. No.47178 of 2014 (3) dt.01-04-2015 looks desirable to impose certain condition so that he should be prevented from continuing with such kind of activity. Accordingly, petitioner is directed to appear before the Sarai P.S. every week till conclusion of instant trial and will file the certificate granted by the Officer-in-charge Sarai P.S. before the learned lower court regularly. In case of fault at the part of the petitioner in submitting attendance slip issued by the Sarai P.S., then in that event, the learned lower court will cancel bail bond of the petitioner. To facilitate execution of order to the learned lower court is directed to serve a copy of the order upon Officer-in-charge Sarai P.S.
