JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-02-2020 Issue of first attempt teacher who passed teachers training in a supplementary/compartmental examination whether to be treated as first attempt or not by a Division Bench of this Court. Therefore, the petitioner cannot be denied the benefit of first attempt if the petitioner has passed training examination in supplementary/compartmental examination. The other issue with regard to the passing of B.A. Hons. And M.A. is concerned. The petitioner has drawn the attention of this Court to Annexure-1 to indicate that after obtaining the prior permission from the concerned authority the petitioner

Considering the aforesaid, this writ petition is disposed of with the direction to the respondents to examine if the petitioner has obtained prior permission of the authority found in Annxures-1 and 2 and petitioner has cleared the Training Examination in Compartmental Examination the benefit of passing Training Examination in first attempt shall be extended to the petitioner. The respondents are directed to take appropriate decision in terms of the acquisition made hereinabove and to grant consequential benefit to the petitioner within a maximum period of four months from the date of receipt/production of the copy of this order. Considering the aforesaid, this writ petition stands disposed of.
