JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 The petitioner seeks regular bail in connection with Bagen Gola P.S. Case No. 88 of 2019, registered for offences punishable under Sections 30 (a) and 37 (2) of Bihar Prohibition and Excise (Amendment), Act, 2018.
Allegation is of recovery of 16.920 litres of liquor from the motorcycle of the petitioner and he was arrested there. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing hs been recovered in this case. Further he has no criminal antecedent and has been in judicial custody since 10.12.2019 and chargesheet has been submitted.

Having heard both sides, in view of the above facts,
Patna High Court CR. MISC. No.7777 of 2020(2) dt.18-02-2020 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge -II-cum-Special Judge (Excise), Buxar,, in connection with Bagen Gola P.S. Case No. 88 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
