Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under sections 395 of the Indian Penal Code.
As per FIR, 6-7 unknown persons boarded on Bolero intercepted the truck and they took away the possession of the truck from the driver and the driver was thrown and the miscreants fled away with the truck.
Learned counsel for the petitioner has submitted that

No.8211 of 2022(2) dt.22-06-2022 2/2 the petitioner has falsely been implicated in this case on the basis of his own confessional statement recorded by the police Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition and he is in custody since 25.11.2021. The impugned order suggest that the looted articles were recovered from the conscious possession of the Ram Niwas Mahto, resident of Village, Murali.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran, in connection with Harshidhi P.S. Case No. 454 of 2021. The application stands allowed.
