The petitioner is languishing in jail since 11.01.2014 in a case instituted under Sections 341, 342, 323, 326, 307, 498A, 304(B) and 34 of the Indian Penal Code in connection with Arrah Town P.S.Case No.18 of 2014 pending in the Court of Adhoc ADJ-III, Arrah.
As per allegation, it is a case of murder of a married lady by the accused persons due to non-fulfilment of demand of dowry by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.01.2014. Chargesheet has been submitted in the case. Petitioner has got no criminal
Patna High Court Cr.Misc. No.38785 of 2015 (3) dt.08-10-2015 antecedent. Petitioner has been made accused only because he is the husband of the deceased. There is no direct or indirect evidence against him.
On behalf of the State, it has been submitted that the petitioner is named in the FIR and he is the husband of the deceased and further there is a direct allegation against him. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the above named petitioner, same is dismissed.
Anyhow the court below is directed to take all necessary steps to conclude the trial of the petitioner preferably within a period of one year from the date of receipt of the production of the order.
