The petitioner seeks bail in connection with Excise P.S. Case No. 16 of 2021 lodged under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that the petitioner is a poor person and nothing was recovered from the conscious possession of the petitioner rather recovery of 4.00 liter illegal Mahua wine was recovered behind the back of the petitioner's house along with two container. Learned counsel for the petitioner submits that charge-sheet has already been filed in
Patna High Court CR. MISC. No.8963 of 2022(2) dt.22-06-2022 2/2 this case, petitioner is in custody since 21.11.2021 having clean antecedent.
Learned A.P.P. opposes the prayer for bail of the petitioner.
Considering the fact that charge-sheet has already been filed, petitioner is in custody since 21.11.2021 having clean antecedent, let the petitioner, above named, be granted bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge-cum-Special Judge (Excise), Bhagalpur in connection with Excise P.S. Case No. 16 of 2021.
