The petitioner, Manoj Sah is in custody in Hayaghat P.S Case No. 33 of 2015 under Section 326,307/34 I.P.C. The prosecution case is that the petitioner who has jewellery shop was quarreling with his brother, who has also another jewellery shop and thereafter they were throwing acid on each of them and in the meantime, the informant reached there and the acid fell on his person.
The learned counsel for the petitioner submitted that there was no intention of the petitioner to kill the informant and when he was quarreling with his brother, the acid fell on the person on the informant.
Considering the above facts and circumstances of the
Patna High Court Cr.Misc. No.50453 of 2015 (2) dt.30-01-2016 2/2 case and nature of the allegation, I direct that the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Hayaghat P.S. Case No. 33 of 2015.
