The petitioner is seeking anticipatory bail in connection with Digha P.S. Case No. 152/2015, G.R. No. 3038/2015 registered under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the petitioner has transpired in the confessional statement of the co-accused. It is also submitted that investigation is pending as on date and no charge-sheet has been filed against the petitioner. Submission is that save and except the confessional statement there is no other material which may indicate involvement of the petitioner in the present case. It is submitted that in the case mentioned in paragraph-3 of the

Patna High Court Cr.Misc. No.8630 of 2019(2) dt.18-02-2019 2/2 application, the petitioner is on bail.

Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail of the petitioner. Considering the facts and circumstances of the case wherein it is submitted that the name of the petitioner has transpired in confessional statement of co-accused and there is no other material to connect this petitioner in the present case, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Patna, in connection with Digha P.S. Case No. 152/2015, G.R. No. 3038/2015, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
