Heard learned counsel for the petitioner and the State. Petitioner is an accused in a case under Section 395 of the Penal Code registered against unknown. His antecedent is not clean as he is implicated in four other cases. It is submitted on behalf of the petitioner that he has been implicated in the present case during investigation though he is co-villager of the informant.

Let the court below confirm the fact that petitioner is co-villager of the informant and if found true, petitioner, named above, be released on bail on furnishing bond of Rs. 5,000/- (Five thousand) with two sureties of the like amount each to the satisfaction of IVth Additional Sessions Judge, Aurangabad (Bihar) in connection with S.Tr. No. 42/014/03/014, arising out of Rafiganj P.S. Case No. 75/013.
