JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-02-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sasaram (M) P.S. Case No. 119 of 2018 for the offenses under Sections 498-A, 419, 420, 467, 468/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is the husband of the informant-opposite party no.2. Due to dispute between the family, the instant case has been registered in which not only the petitioner-husband but the son of the informant and the petitioner was also made accused. He further submits that the marriage took place 20 years back and

Considering the fact that the petitioner is the husband, marriage took place 20 years back and there is chance of restoration of good relationship, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (M) P.S. Case No. 119 of 2018. The court below is directed to refer the matter to the Mediation Center so that the dispute between the husband and wife is amicably settled.
