The petitioner apprehends his arrest in connection with Thawe P.S. Case No. 107 of 2020 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307 and 379 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that on perusal of the first information report, it is evident that there is specific allegation against co-accused persons namely, Taju Ali and Yusuf Ali. There is no specific allegation against the

Patna High Court CR. MISC. No.19542 of 2021(2) dt.07-01-2022 2/2 petitioner. It is submitted that petitioner is a member of mob and there is no criminal history against him.

Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Thawe P.S. Case No. 107 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
