Heard learned counsel for the petitioners.
The petitioners apprehend their arrest in connection with Kuchaikote P.S. Case No. 298 of 2020, registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
The allegation against the petitioners is that they used
Patna High Court CR. MISC. No.19547 of 2021(2) dt.22-01-2022 2/3 to torture the deceased for non-fulfillment of dowry demand and when the informant went to the matrimonial house of the deceased, he saw her dead body which was kept on chowki. Learned counsel for the petitioners has submitted that the order of learned District & Sessions Judge-Vth, Gopalganj dated 11.11.2020, shows that the independent witnesses in paragraph-26, 27 and 28 of the case diary have stated that the deceased was asking her matrimonial inmates for going to her maike but the matrimonial inmates asked her that it was the month of bhado, as such, she should not go to her native place and it was the reason that she committed suicide by strangulating herself.
Considering the above-mentioned facts and circumstances, let the petitioners be released on anticipatory bail in the event of their arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-7th, Gopalganj, in connection with Kuchaikote P.S. Case No. 298 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the
Patna High Court CR. MISC. No.19547 of 2021(2) dt.22-01-2022 3/3 petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
