JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Complaint Case No. 1358(C) of 2018 for offences under Sections 498A, 379 and 323/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The allegation against the petitioners is that they have tortured opposite party no. 2 for non-fulfillment of dowry demand.

Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.14249 of 2020(2) dt.06-07-2020 2/2 petitioners have no criminal antecedent. Petitioner no.1 is the husband of the complainant (opposite party no. 2), petitioner no. 2 is the mother-in-law and petitioner no. 3 is Devar of the complainant. Learned counsel submits that petitioner no.1 is ready to keep his wife (opposite party no. 2) with full honour and dignity.

Considering the aforesaid, this Court is inclined to grant bail petitioners. Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Mrs. Saroj Kumari, Additional Chief Judicial Magistrate-IV, Saharsa in connection with Complaint Case No. 1358(C) of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

In the event the petitioners neglect, misbehave or torture the complainant (opposite party no. 2), the court below shall be at liberty to cancel their bail bonds. (Anil Kumar Upadhyay, J) BT/- U T
