The petitioner apprehends his arrest in Kazi Mohammadpur P.S. Case No. 269 of 2021, registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.

As per the prosecution case, in the night of 12.09.2021 theft was committed at the house of informant and all the valuable and household articles were stolen away. It is further alleged that on the alleged date of occurrence, informant was not at her house and for security of her house she had got BST security guard deputed and despite that by breaking the lock of her house theft was committed and her neighbour

Patna High Court CR. MISC. No.9770 of 2022(2) dt.04-08-2022 2/3 informed her about the theft. It is also alleged that CCTV camera were also stolen away.

It is submitted that petitioner has been falsely implicated in this case. Petitioner runs a security agency and he has deputed one guard namely, Satish Kumar, but he neither attended his duty nor informed the petitioner about his absence and due to absence of security guard theft was committed. After getting informant of theft, he gave a written report to the police to this effect and thus, petitioner has got no role in the entire episode. Moreover, FIR has been lodged after delay of five days of the occurrence. No incriminating article has been recovered either from his possession or from his house. Petitioner has got clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist (East), Muzaffarpur in connection with Kazi Mohammadpur P.S. Case No. 269 of 2021, subject to the conditions as laid
