Neither petitioner was caught on the spot nor any thing was recovered from his conscious possession and name of the petitioner was disclosed by co-accused who were caught on the spot and firearms were recovered from their possession. Moreover, co-accused Md Sabir @ Pandit, who was caught on the spot and recovery was made from his possession, has already been granted privilege of bail by a coordinate bench of this court. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in Bettiah Town P.S.
