The petitioner seeks bail in Baniapur P.S. Case No. 390 of 2021, registered for the offence punishable under Sections 461, 379 and 411 of the Indian Penal Code. On the disclosure statement of this petitioner looted articles were recovered.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case merely on suspicion. Petitioner is neither named in the FIR nor any incriminating article has been recovered from his possession. Petitioner is in custody since 13.10.2021.

Learned APP however, vehemently opposed the prayer for bail.

No.8592 of 2022(3) dt.16-05-2022 2/2 Considering the facts aforesaid and the nature of allegation and the fact that on the disclosure of this petitioner looted articles were recovered, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
